When The-Dream filed for divorce from Christina Milian in February, it came as a surprise to his wife, who was nine days away from giving birth to the couple’s daughter. Now Milian is asking a judge to throw out the divorce papers.

According to TMZ, Christina claims that the father of her child not only lied about the status of their relationship, but also cheated on her.

Despite The-Dream publicly announcing the end of their marriage, Milian insists it was quite the contrary and that the two even had “marital relations on numerous occasions” after the paperwork was filed.

If the court does grant the divorce, Milian wants it to be for reasons other than that their marriage was “irretrievably broken,” instead claiming that The-Dream was cheating on her.

In her legal response, filed last week in Georgia, Milian admits that she signed an agreement with The-Dream that waived alimony or ownership rights to each other’s property. However, she maintains that she was in no state to sign such documents because they were brought to her when she was nine months pregnant.

In her legal response, filed last week in Georgia, Milian claims the marriage wasn’t really kaput when he filed the divorce docs — and subsequently had “marital relations on numerous occasions.”

But Milian also claims that if the court does grant the divorce — it shouldn’t be based on The-Dream’s claim that the marriage is “irretrievably broken” — but rather because the The-Dream was cheating on her.

In the docs, Milian admits that she signed a settlement agreement with The-Dream in which both parties waved any alimony or ownership right’s to the other person’s property.

But Milian claims she only signed the docs because The-Dream brought them to her bedside when she was 9-months pregnant … when she was in no condition to sign such important papers.

The-Dream filed divorce papers in Georgia on February 17, just 9 days before Christina gave birth to their now 5-month old baby girl Violet.

This was also just five months after their wedding.

He cited the usual celebrity “favorite” – irreconcilable differences – as being the reason for their break-up.

The papers also state that the marriage is “irretrievably broken.”

Christina Milian’s mom is speaking out for the first time since her soon-to-be ex son-in-law was busted getting cozy with his assistant in the Caribbean. HipHollywood’s Kevin Frazier spoke exclusively to Carmen Milian, and she told us that the only thing she is focused on right now is the well-being of her daughter and grandchild.

“I love them both so much and that is all I care about right now. I want to make sure that I protect my daughter and granddaughter.”

Carmen had absolutely nothing to say about The Dream and added that, as a rule, she tries stay out of her kids’ romantic endeavors.

“I don’t get involved in any of my children’s relationships. What they do is up to them.”

She went on to explain that Milian and her family refuse to get caught up in bashing The-Dream, as they are more concerned with getting through this difficult time.

Christina was photographed earlier in the week still wearing her wedding ring and according to reports, she was completely blindsided by her husband’s apparent affair.

The-Dream has decided to break his silence and issue a statement regarding the situation via his official site. Mr. Nash has taken “full responsibility” for the situation and noted that his marriage to the singer had been “failing” for a while.

In My Own Words:

First I want to thank God for the trials of life, without them we can’t know purpose!

I would love to tell the truth as to why my relationship wasn’t successful, but today that is between me and Christina. Its easy to say that it’s because of another woman or a new relationship but truthfully, IT’S NOT.

I take FULL RESPONSIBILITY for misleading everyone into thinking everything was fine and okay when we knew problems existed for awhile! I wanted to speak up but we decided it wasn’t for anyone to know. I would NEVER intentionally hurt a soul and everyone around me knows that! There was so much going on in me and Christina’s personal world that I tried to deal with it as delicately as I could and tried to regain my footing. Instead of being direct in order not to cause even more hurt or hurt someone’s feelings, I carried the weight in secret!

I am Human and people fall in and out of Love all the time… This is Life. Nothing’s promised or perfect, neither am I. I am not proud that I lost something we once had…LOVE! I’ve always been a Loving Father, Hard Worker, Generous, Stern and Eager to prove myself. My faults are I can be irresponsible and an ass sometimes, but I HAVE NEVER and WILL NEVER be a malicious person or wish harm to anyone, especially those I love or the mother of my child. I’m sorry for the embarrassment to everyone involved! If there’s anyone to blame and you can’t fathom this happening, please blame me and me alone for not being upfront! Even though we were trying to overcome personal things between us, I was just simply scared and embarrassed to let everyone know we WERE FAILING and HAVE NOW FAILED!

This is not to justify anything, it’s true emotion! It’s a real thing that involves real people! I’ve cried about this for months, after interviews, after prayer and I’ve tried to take my own life at a point because of the failure that was looming.

But I was reminded by my MOTHER that I am not “Superman” and its okay to lose sometimes…

MTO received word from one of Christina’s closest friends. She is furious with The-Dream and what he did to Christina. Here is the report:

I am very close with Christina and she has never removed her ring because she and Dream never broke up. His announcement was the first time he ever expressed not wanting to spend the rest of his life with her and at this moment she is a distraught mother and wife. With that kind of shock I don’t think she has even considered taking it off yet.. everything happened so fast.

Christina has real family and friends supporting her because she is 100% real and is an absolute joy to be around. The-Dream is the devil and anyone close to him is paid to be there and he could never get over that; that was the ONLY problem in their relationship. He is crazy. He was mentally controlling and abusive. Now that he has recently turned his back on Christina the clouds are clearing and she is no longer in the brainwashed state he had her in.

It made me sick to be near her on the phone with him. She apologized for everything just to move on from the issue even when she was guilty of nothing. Christina moved to Atlanta while everyone was in LA and it became clear that all anyone could do to make her happy at that time was let her go – and they did, but he continued to go at her with the same problems while she dedicated this “new life” to him, pushing aside her career and family for him. Christina was forced to play mommy to a newborn and to a full grown man and had no time to tend to herself.
